Mexico Launches Accelerated Patent Grant Initiative in Collaboration with USPTO

On November 13, the Mexican Institute of Industrial Property (IMPI) implemented the new Accelerated Patent Grant (APG) initiative in partnership with the USPTO. This initiative offers eligible patent applicants the opportunity to expedite the process of obtaining a patent grant in Mexico, based on an existing U.S. patent grant.


To be eligible for APG, a Mexican application must meet at least one of the following criteria:

  1. Validly claims priority under the Paris Convention of a USPTO application;
  2. Shares a common priority with a corresponding USPTO application (e.g., both applications are national phase entry applications of a common PCT application).

 


The new APG initiative streamlines the processes for IMPI to issue patents in Mexico for those with granted US patents. It allows applicants to obtain protection for their inventions and ideas more quickly while (presumably) saving on patent prosecution costs in Mexico.
